M\u00fclk sahibi olmay\u0131 d\u00fc\u015f\u00fcn\u00fcyorsan\u0131z <a href=\"https:\/\/www.konaak.com\/blog\/ev-alirken-dikkat-edilmesi-gerekenler\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ev Al\u0131rken Dikkat Edilmesi Gerekenler<\/a> konulu yaz\u0131m\u0131za da g\u00f6z atman\u0131zda fayda var.<\/p>\n\n\n\n<p>Peki <strong>kat irtifak\u0131 ve kat m\u00fclkiyeti aras\u0131ndaki farklar nelerdir?<\/strong> Bunlar\u0131 \u015fu \u015fekilde s\u0131ralayabiliriz:<\/p>\n\n\n\n<ol>\n<li>Kat m\u00fclkiyeti ve kat irtifak\u0131 aras\u0131ndaki farklar aras\u0131ndaki en temel nokta iskan belgesi. \u00c7\u00fcnk\u00fc kat irtifakl\u0131 bir binada yap\u0131 kullan\u0131m izni bulunmuyor. \u0130\u015fte bu y\u00fczden iskan belgesi kat m\u00fclkiyetine ge\u00e7i\u015f a\u015famas\u0131nda en \u00f6nemli \u015fartlar aras\u0131nda.<\/li>\n\n\n\n<li>\u0130rtifak al\u0131m\u0131 i\u00e7in in\u015faat\u0131n ba\u015flam\u0131\u015f fakat hen\u00fcz tamamlanmam\u0131\u015f olmas\u0131 gerekli. Kat m\u00fclkiyeti tapusundaysa in\u015faat\u0131n bitmi\u015f olmas\u0131 s\u00f6z konusu. K\u0131sacas\u0131; in\u015faat s\u00fcresince ge\u00e7erli olan kat irtifak\u0131, sadece ge\u00e7ici bir s\u00fcreli\u011fine al\u0131nacak bir belge denilebilir.<\/li>\n\n\n\n<li>\u0130rtifakta m\u00fclkiyet hakk\u0131 arsa pay\u0131 cinsiyle belirtilir. Yani bir yap\u0131daki t\u00fcm daire sahiplerine arsadan pay verilmi\u015f olur. Kat m\u00fclkiyetindeyse arsa niteli\u011fi art\u0131k ortadan kalkar ve ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin tapudaki niteli\u011fi bina olarak belirtilir.<\/li>\n\n\n\n<li>Kat m\u00fclkiyetine sadece in\u015fas\u0131 tamamlanan yap\u0131lar sahip olabildi\u011fi i\u00e7in yap\u0131n\u0131n projesine uygun bir \u015fekilde in\u015fa edilmeme riski gibi bir durum s\u00f6z konusu olmaz. \u0130rtifak sahibi binalardaysa in\u015faat\u0131n bitimiyle proje hatalar\u0131 ger\u00e7ekle\u015febilir.<\/li>\n\n\n\n<li>\u0130rtifak\u0131 olan bir binan\u0131n y\u0131k\u0131lmas\u0131 gibi bir senaryoda hissedarlara tapuda belirtilmi\u015f arsa pay\u0131 \u00fczerinden hak verilir. Kat m\u00fclkiyetli tapu sahipleriyse binan\u0131n yeniden in\u015fas\u0131 durumunda sahip olduklar\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler kadar hak sahibi olabilirler.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Kat_Irtifakindan_Kat_Mulkiyetine_Gecis\"><\/span>Kat \u0130rtifak\u0131ndan Kat M\u00fclkiyetine Ge\u00e7i\u015f<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/www.konaak.com\/blog\/wp-content\/uploads\/2022\/11\/What-is-a-Flat-Ownership-What-is-a-Flat-Property-What-is-a-Flat-Property-Transition-from-Flat-Ownership-to-Flat-Property.jpg\" alt=\"\" class=\"wp-image-16796\"\/><\/figure>\n\n\n\n<p>Yukar\u0131da da aktard\u0131\u011f\u0131m\u0131z gibi kat irtifak\u0131, binan\u0131n in\u015fas\u0131 tamamlanana kadar ge\u00e7erli bir belge. Bina tamamland\u0131ktan sonra kat irtifak\u0131ndan <strong>kat m\u00fclkiyetine ge\u00e7i\u015f<\/strong> yap\u0131lmas\u0131 gerekir. Fakat binan\u0131n in\u015fas\u0131n\u0131n irtifak al\u0131m\u0131ndan sonraki 5 y\u0131l i\u00e7erisinde tamamlanm\u0131\u015f olmas\u0131 gerekir. Binan\u0131n yap\u0131m\u0131 belirtilen bu 5 y\u0131ll\u0131k s\u00fcre i\u00e7inde tamamlanmam\u0131\u015fsa hisse sahipleri itirazda bulunabilir ve irtifak\u0131 bozabilir.<\/p>\n\n\n\n<p>Peki kat irtifak\u0131 kat m\u00fclkiyetine nas\u0131l \u00e7evrilir?<\/p>\n\n\n\n<ol>\n<li>Yap\u0131n\u0131n sadece bir k\u0131sm\u0131 i\u00e7in kat m\u00fclkiyeti yap\u0131lamaz. Bu y\u00fczden irtifak hakk\u0131na sahip t\u00fcm maliklerin onay\u0131 gerekli.
