Bu dava yoluyla kira bedelinin piyasa ko\u015fullar\u0131na g\u00f6re uygun de\u011fere uyarlanmas\u0131 ama\u00e7lan\u0131r. Dava sonucunda mahkeme taraf\u0131ndan belirlenen kira bedelindeki art\u0131\u015f haricinde kirac\u0131n\u0131n aleyhine kira s\u00f6zle\u015fmesinde de\u011fi\u015fiklik yap\u0131lamaz. Kira bedelinin tespiti davas\u0131na ili\u015fkin d\u00fczenlemeler <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.6098.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu<\/a>\u2019nda yer al\u0131r.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Kira Tespit Davas\u0131 5 Y\u0131ll\u0131k S\u00fcre Kural\u0131 Nedir?<\/h3>\n\n\n\n<p>Be\u015f y\u0131l\u0131n alt\u0131ndaki kira s\u00f6zle\u015fmelerinde e\u011fer taraflar kira art\u0131\u015f oran\u0131 belirlememi\u015fse mahkeme t\u00fcketici fiyat endeksindeki (T\u00dcFE) 12 ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131n \u00fczerinde karar veremez. Gelin, bu ne anlama gelir daha detayl\u0131 olarak inceleyelim.<\/p>\n\n\n\n<p>Ev sahibi ve kirac\u0131 aras\u0131ndaki kira s\u00f6zle\u015fmesi 5 y\u0131l\u0131 doldurmam\u0131\u015fsa ve taraflar aras\u0131nda kira bedelinin art\u0131\u015f\u0131na ili\u015fkin bir anla\u015fma belirlenmemi\u015fse mahkemede emsal de\u011fer durumuna ve evin durumuna g\u00f6re bir kira art\u0131\u015f oran\u0131 belirlenir. Mahkeme taraf\u0131ndan belirlenecek olan kira art\u0131\u015f oran\u0131 t\u00fcketici fiyat endeksindeki 12 ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131 \u00fczerinde olamaz.<\/p>\n\n\n\n<p><strong>Kira bedelinin tespiti davas\u0131 e\u011fer 5 y\u0131ldan daha fazla s\u00fcrm\u00fc\u015f olan bir kira s\u00f6zle\u015fmesine dayanarak a\u00e7\u0131l\u0131yorsa<\/strong> mahkeme T\u00dcFE oran\u0131na ba\u011fl\u0131 kal\u0131nmadan T\u00dcFE\u2019nin \u00fczerinde bir art\u0131\u015fa karar verebilir. Bu karar al\u0131n\u0131rken bilirki\u015fi taraf\u0131ndan mevcut piyasa durumu ve kirac\u0131n\u0131n evde kald\u0131\u011f\u0131 s\u00fcre gibi bir \u00e7ok durum ele al\u0131n\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5 Y\u0131l Ge\u00e7meden Kira Bedelinin Tespiti Davas\u0131 A\u00e7\u0131labilir mi?<\/h3>\n\n\n\n<p><strong>Kira bedelinin yeniden belirlenmesi talebiyle a\u00e7\u0131lan davalar\u0131n ge\u00e7erlilik s\u00fcresi 5 y\u0131ld\u0131r. <\/strong>Bu sebeple davan\u0131n \u00fczerinden 5 y\u0131l ge\u00e7meden yenisi a\u00e7\u0131lamaz. Fakat e\u011fer farkl\u0131 bir ev sahibine veya farkl\u0131 bir kirac\u0131ya kira bedelinin tespiti davas\u0131 a\u00e7\u0131lmas\u0131 hakk\u0131nda b\u00f6yle bir d\u00fczenleme bulunmaz, yani taraflardan birisi farkl\u0131ysa 5 y\u0131l bekleme zorunlulu\u011fu yok.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Geriye D\u00f6n\u00fck Kira Tespit Davas\u0131<\/h3>\n\n\n\n<p>Belirlenecek kira bedeli, ev sahibi ve kirac\u0131 aras\u0131ndaki kira s\u00f6zle\u015fmesinde ileri d\u00f6nemler i\u00e7in talep edilebilir. Fakat Hukuk Muhakemeleri Kanunu\u2019na uygun bir dilek\u00e7e haz\u0131rlanmal\u0131. Ev sahibi ve kirac\u0131 aras\u0131nda s\u00f6zl\u00fc bir anla\u015fma yap\u0131lm\u0131\u015fsa da bu dava g\u00f6r\u00fclebilir.<\/li>\n\n\n\n<li><strong>Hukuki yarar: <\/strong>Davay\u0131 a\u00e7an ki\u015finin, yani ev sahibinin ya da kirac\u0131n\u0131n davay\u0131 a\u00e7mada hukuki yarar\u0131n\u0131n bulunmas\u0131 gerekir. \u00d6rne\u011fin, kira zam oran\u0131 yasal s\u0131n\u0131rlar i\u00e7erisinde ger\u00e7ekle\u015fmi\u015fse kira bedelinin tespiti davas\u0131nda bir hukuki yarar bulunmaz.&nbsp;<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Kira_Tespit_Davasi_Ne_Zaman_Acilir\"><\/span>Kira Tespit Davas\u0131 Ne Zaman A\u00e7\u0131l\u0131r?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.konaak.com\/blog\/wp-content\/uploads\/2022\/12\/What-is-a-Rent-Determination-Case-How-is-Rent-Determined-When-to-File-a-Rent-Determination-Case.jpg\" alt=\"\" class=\"wp-image-17377\"\/><\/figure>\n\n\n\n<p>Davan\u0131n ne zaman a\u00e7\u0131laca\u011f\u0131na ili\u015fkin bir s\u0131n\u0131rlama bulunmuyor. Fakat davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 tarihe g\u00f6re mahkeme taraf\u0131ndan belirlenen yeni kira bedelinin hangi kira d\u00f6neminde uygulanaca\u011f\u0131 farkl\u0131l\u0131k g\u00f6sterebilir. Yani e\u011fer kira bedelinin tespiti davas\u0131 yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan <strong>en az<\/strong> <strong>30 g\u00fcn \u00f6nceden<\/strong> a\u00e7\u0131lm\u0131\u015f olursa mahkeme belirleyece\u011fi kira bedelini yeni kira d\u00f6nem ba\u015flang\u0131c\u0131ndan itibaren olarak karar verebilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Kira Tespit Davas\u0131 \u0130htar \u015eart\u0131<\/h3>\n\n\n\n<p>Kira bedelinin tespiti davalar\u0131nda ihtar \u015fart\u0131, taraflar\u0131n dava a\u00e7abilmeleri i\u00e7in en fazla 30 g\u00fcn olarak belirlenmi\u015f bir s\u00fcreleri olmas\u0131na denir. Bu 30 g\u00fcnl\u00fck s\u00fcre kira s\u00f6zle\u015fmesi bitmeden ki\u015filere verilen s\u00fcre olarak ge\u00e7er. Bu s\u00fcre i\u00e7erisinde a\u00e7\u0131lmam\u0131\u015f davalar ge\u00e7ersiz say\u0131l\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Kira_Tespit_Davasi_Vekalet_Ucreti_Ne_Kadardir\"><\/span>Kira Tespit Davas\u0131 Vekalet \u00dccreti Ne Kadard\u0131r?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>T\u00fcrkiye Barolar Birli\u011fi taraf\u0131ndan her y\u0131l bir avukat \u00fccret tarifesi yay\u0131nlan\u0131r. Bu tarifede belirtilen \u00fccret asgari olup avukat\u0131n bu \u00fccret alt\u0131nda vekalet \u00fccreti belirleyememesi gibi durum s\u00f6z konusu. Kira bedelinin tespiti davas\u0131, sulh hukuk mahkemesinde i\u015fleme al\u0131nd\u0131\u011f\u0131ndan bu tarifede belirtilen sulh hukuk mahkemesi \u00fccretinden d\u00fc\u015f\u00fck \u00fccret kararla\u015ft\u0131r\u0131lamaz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Kira_Tespit_Davasi_Masraflarini_Kim_Oder\"><\/span>Kira Tespit Davas\u0131 Masraflar\u0131n\u0131 Kim \u00d6der?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Kira bedelinin tespiti davas\u0131nda yarg\u0131lama giderleri her dosyaya g\u00f6re de\u011fi\u015fkenlik g\u00f6sterebilir. Ancak her dava a\u00e7\u0131l\u0131rken mutlaka har\u00e7 ve gider avans\u0131 yat\u0131r\u0131lmas\u0131 \u015fart.
