Maalesef pandemi sonras\u0131 zamlar, ekonomik kriz ve vergi oranlar\u0131yla do\u011fru orant\u0131l\u0131 \u015fekilde h\u0131zla artan kira bedelleri ev sahipleri ve kirac\u0131lar aras\u0131ndaki anla\u015fmazl\u0131klar\u0131 alevlendiriyor. Bu nedenle hem ev sahiplerini hem de kirac\u0131lar\u0131 koruyacak yeni uygulamalar hayata ge\u00e7irilmeye ba\u015fland\u0131. B\u00f6ylece ev sahiplerinin haks\u0131z yapt\u0131r\u0131mlar\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilmesi ve iki taraf\u0131n da haklar\u0131n\u0131n g\u00fcvence alt\u0131na al\u0131nmas\u0131 planlan\u0131yor. Biz de bu yaz\u0131m\u0131zda ev sahibi ve kirac\u0131 anla\u015fmazl\u0131klar\u0131 ile ilgili t\u00fcm detaylar\u0131 listeledik.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kirac\u0131 Ev Sahibini \u015eikayet Edebilir Mi?<\/h2>\n\n\n\n<p>Bildi\u011finiz \u00fczere son d\u00fczenlemeler sonucunda ev sahiplerinin kira bedeline yapabilece\u011fi azami kira art\u0131\u015f\u0131na 1 Temmuz 2023\u2019e kadar maksimum y\u00fczde 25 art\u0131\u015f olacak \u015fekilde bir s\u0131n\u0131rlama getirilmi\u015fti. Bu s\u0131n\u0131rlama sayesinde kirac\u0131lar <a href=\"https:\/\/www.cimer.gov.tr\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">C\u0130MER<\/a> \u00fczerinden y\u0131l sonunda kiraya yasal s\u0131n\u0131rdan daha fazla zam yapan ev sahiplerini \u015fikayet etme hakk\u0131na sahip oluyor. Dolay\u0131s\u0131yla anormal kira art\u0131\u015flar\u0131n\u0131n ve kirac\u0131lar\u0131n ma\u011fduriyetlerinin azalaca\u011f\u0131 umut ediliyor. Bu konuya istinaden <a href=\"https:\/\/www.konaak.com\/blog\/ev-sahibi-kiraya-ne-kadar-zam-yapabilir\/#:~:text=8%20Haziran%202022%20tarihli%20TBBM,oran%C4%B1%20y%C3%BCzde%2025'i%20ge%C3%A7emeyecek.\" target=\"_blank\" rel=\"noreferrer noopener\">Ev Sahibi Kiraya Ne Kadar Zam Yapabilir?<\/a> adl\u0131 blog yaz\u0131m\u0131za da g\u00f6z atman\u0131z\u0131 \u00f6neriyoruz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ev Sahibi \u015eikayet Hatt\u0131<\/h2>\n\n\n\n<p>Asl\u0131nda May\u0131s 2022\u2019de ev sahibi ve kirac\u0131 anla\u015fmazl\u0131klar\u0131n\u0131 en aza indirmek ama\u00e7l\u0131 bir Ev Sahibi \u015eikayet Hatt\u0131 kurulmas\u0131 planlan\u0131yordu. Kirac\u0131lar kira s\u00f6zle\u015fmeleri dolmadan evden \u00e7\u0131kmalar\u0131 konusunda bask\u0131c\u0131 olan veya haks\u0131z oranda zam yapan ev sahiplerini 189\u2019u arayarak veya <a href=\"https:\/\/www.cimer.gov.tr\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">C\u0130MER<\/a> ya da e-Devlet \u00fczerinden ihbar formu doldurarak \u015fikayet edebilecektir. Fakat kira zamlar\u0131na getirilen s\u0131n\u0131rlamalar vb. uygulamalardan sonra bu proje y\u00fcr\u00fcrl\u00fc\u011fe ge\u00e7meden durduruldu.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ev Sahibi ve Kirac\u0131 Anla\u015fmazl\u0131klar\u0131 Nelerden Dolay\u0131 Ortaya \u00c7\u0131k\u0131yor?<\/h2>\n\n\n\n<p>Ev sahibi ve kirac\u0131 anla\u015fmazl\u0131klar\u0131n\u0131n bir\u00e7ok sebebi olabiliyor fakat en \u00e7ok sorunun \u00e7\u0131kt\u0131\u011f\u0131 konular\u0131 a\u015fa\u011f\u0131daki gibi \u00f6zetleyebiliriz:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Kira Bedeli:&nbsp;<\/h3>\n\n\n\n<p>Yukar\u0131da da belirtti\u011fimiz gibi ev sahibi ve kirac\u0131 anla\u015fmazl\u0131klar\u0131n\u0131n ba\u015fl\u0131ca nedeni genelde kira bedeli oluyor. Y\u0131ll\u0131k enflasyonun b\u00fcy\u00fck \u00f6l\u00e7\u00fcde etkiledi\u011fi kira zamm\u0131 oranlar\u0131na azami s\u0131n\u0131rlama getirildi. Fakat bazen ev sahipleri yasalara ayk\u0131r\u0131 \u015fekilde kiray\u0131 \u00e7ok daha fazla oranlarda art\u0131rmak isteyebiliyor. Bu durumda kirac\u0131 yasal \u00e7er\u00e7evenin d\u0131\u015f\u0131nda yap\u0131lan bir zamm\u0131 kabul etmekle y\u00fck\u00fcml\u00fc de\u011fil ve gerekirse hakk\u0131n\u0131 hukuki yollardan arayabiliyor.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Depozito Bedeli:&nbsp;&nbsp;<\/h3>\n\n\n\n<p>Ev sahiplerinin kirac\u0131lar\u0131ndan toplamda 3 adet kira bedelini ge\u00e7meyecek miktarda depozito bedeli talep etme hakk\u0131 bulunuyor. Depozitonun kirac\u0131 evden \u00e7\u0131karken geri verilip verilmemesi konusuysa ev sahibi ve kirac\u0131 anla\u015fmazl\u0131klar\u0131n\u0131n en b\u00fcy\u00fck sebeplerinden biri. Belli durumlarda kirac\u0131n\u0131n vermi\u015f oldu\u011fu depozitoyu geri alma hakk\u0131 ortadan kalk\u0131yor. Kirac\u0131y\u0131 kira s\u00f6zle\u015fmesi tamamlanmadan evden \u00e7\u0131karma hakk\u0131na sahip olmas\u0131 i\u00e7in spesifik \u015fartlar\u0131n sa\u011flanmas\u0131 gerekiyor:<\/p>\n\n\n\n<ul>\n<li>M\u00fclk\u00fcn tadilata girmesi<\/li>\n\n\n\n<li>Ev sahibinin kendisinin veya ailesinde bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filerin o m\u00fclkte oturmaya ihtiyac\u0131 olmas\u0131<\/li>\n\n\n\n<li>Ev sahibinin evi ba\u015fkas\u0131na satmas\u0131 ve satt\u0131\u011f\u0131 ki\u015finin 6 ay i\u00e7inde kirac\u0131n\u0131n \u00e7\u0131kmas\u0131n\u0131 talep etmesi<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Kirac\u0131n\u0131n Kiray\u0131 Vaktinde \u00d6dememesi:<\/h3>\n\n\n\n<p>Bir di\u011fer ev sahibi ve kirac\u0131 anla\u015fmazl\u0131\u011f\u0131 sebebiyse kirac\u0131lar\u0131n kiray\u0131 vaktinde \u00f6demiyor olmalar\u0131. Bu durumda ev sahibinin ba\u015fvurabilece\u011fi y\u00f6ntem kirac\u0131ya yaz\u0131l\u0131 (s\u00f6zl\u00fc olmamas\u0131 burada \u00f6nemli bir nokta) olarak iki adet hakl\u0131 ihtarda bulunmak. Ev sahibi bu yaz\u0131l\u0131 beyanda kirac\u0131ya belirli bir s\u00fcre tan\u0131yarak bu s\u00fcrenin sonunda kirac\u0131 hala kira bedelini \u00f6dememi\u015f olursa s\u00f6zle\u015fmeyi feshedebiliyor. Tan\u0131nacak s\u00fcrenin konutlarda ve i\u015fyeri kiralamalar\u0131nda en az 30 g\u00fcn olmas\u0131 gerekiyor.&nbsp;<\/p>\n\n\n\n<p>Ev sahibi ve kirac\u0131 anla\u015fmazl\u0131klar\u0131 hakk\u0131nda verebilece\u011fimiz t\u00fcm bilgiler bunlar.
