Bahsi ge\u00e7en bu kurallar yaz\u0131l\u0131 halde bulunur ve apartmanlarda\/sitelerde ya\u015fayan sakinlerin huzuru ve g\u00fcveni i\u00e7in gereklidir.&nbsp; \u0130\u015fte, <strong>apartman y\u00f6netim plan\u0131<\/strong> da bir apartman\u0131n y\u00f6netimine dair kurallar\u0131n, y\u00f6netime d\u00fc\u015fen sorumluluklar\u0131n ve apartman g\u00f6revlilerinin alacaklar\u0131 \u00fccret gibi apartmanla ilgili meselelerin bir arada bulundu\u011fu belgeye denir. Bu belge, apartmandaki b\u00fct\u00fcn hak sahiplerini ba\u011flayac\u0131 niteliktedir. Bu konular\u0131n ba\u015f\u0131nda apartman\u0131n veya sitenin y\u00f6netim tarz\u0131, ortak alanlar\u0131n ve e\u015fyalar\u0131n kullan\u0131lmas\u0131 ve apartmanda ya\u015fayan ki\u015filerin uymas\u0131 gereken belirli kurallar yer al\u0131r.&nbsp;<\/p>\n\n\n\n<p>Y\u00f6netim plan\u0131 da \u00fcstte s\u0131ralad\u0131\u011f\u0131m\u0131z hususlar\u0131 ve apartman\u0131n y\u00f6netimini kapsayan di\u011fer t\u00fcm konular\u0131 d\u00fczenleyen y\u00f6netim plan\u0131na verilen isim. Belirtti\u011fimiz gibi bir s\u00f6zle\u015fme niteli\u011finde olan apartman y\u00f6netim plan\u0131 ana gayrimenkul\u00fcn y\u00f6netimiyle ilgili anla\u015fmazl\u0131klarda bu kanuna g\u00f6re karar al\u0131nmas\u0131nda yard\u0131mc\u0131 olur. Bu duruma ek olarak kat malikleri aras\u0131nda birden fazla ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm \u00fczerinde oy hakk\u0131 olanlar varsa s\u00f6z konusu her ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm i\u00e7in bu ki\u015fi ayr\u0131ca oy hakk\u0131na sahip. B\u00fct\u00fcn kat maliklerini ba\u011flayacak olan bu s\u00f6zle\u015fmenin olu\u015fumu ve de\u011fi\u015fimi i\u00e7in o ki\u015finin s\u00f6z hakk\u0131ysa en fazla \u00fc\u00e7te bir oran\u0131nda olur. Bu \u015fart\u0131n sa\u011flanmas\u0131yla Tapu ve Kadastro M\u00fcd\u00fcrl\u00fc\u011f\u00fcne ba\u011fl\u0131 ilgili tapu m\u00fcd\u00fcrl\u00fcklerine apartman y\u00f6netim plan\u0131 belgesinin \u015ferh edilmesi gerek. Bu belgenin \u015ferhiyle apartmana veya siteye \u00f6zel bir y\u00f6netim plan\u0131 olu\u015fturulmu\u015f olur.&nbsp;<\/p>\n\n\n\n<p>Olu\u015fturulmu\u015f bu y\u00f6netim plan\u0131yla kat malikleri genel kurulun sorumlulu\u011funda ortak olarak uygulanacak kararlar\u0131n al\u0131nmas\u0131n\u0131 sa\u011flar. Al\u0131nm\u0131\u015f kararlarsa denetim kurulu taraf\u0131ndan kontrol edilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Apartman_Yonetim_Planina_Nereden_Ulasilir\"><\/span>Apartman Y\u00f6netim Plan\u0131na Nereden Ula\u015f\u0131l\u0131r?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Tescil i\u015flemlerinin ger\u00e7ekle\u015ftirilebilmesi i\u00e7in kat irtifak\u0131 s\u0131ras\u0131nda y\u00f6netim plan\u0131n\u0131n da tapuya verilmesi ko\u015fulu bulunuyor. Bu sayede tapu siciliyle ilgisi olan herkes tapuda bulunan belgelerin kendisine g\u00f6sterilmesini isteyebilir. Bu belgeleri g\u00f6sterme ve ki\u015finin iste\u011fine g\u00f6re belgenin \u00f6rne\u011fini alabilmesi i\u015flemi bir tapu memuru tan\u0131kl\u0131\u011f\u0131nda ger\u00e7ekle\u015fir. Apartman ve site y\u00f6netim plan\u0131n\u0131n olu\u015fturulmas\u0131 s\u0131ras\u0131ndaki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlere sahip ki\u015filerin yaz\u0131m\u0131zda daha \u00f6nceden belirtti\u011fimiz oy oran\u0131 bu durumda da ge\u00e7erli olur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Apartman_ve_Site_Yonetim_Plani_Nasil_Iptal_Edilir\"><\/span>Apartman ve Site Y\u00f6netim Plan\u0131 Nas\u0131l \u0130ptal Edilir?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Y\u00f6netim plan\u0131 iptali ile y\u00f6netim plan\u0131 de\u011fi\u015fimi farkl\u0131 seyreden i\u015flemler. \u00c7\u00fcnk\u00fc y\u00f6netim plan\u0131n\u0131n tamamen iptal edilmesi gibi bir durum olamaz. Fakat y\u00f6netim plan\u0131 i\u00e7in kat maliklerinin genel kurula iletecekleri de\u011fi\u015fiklik talebi kabul edilmezse ya da de\u011fi\u015fiklik i\u00e7in yeterli oy \u00e7oklu\u011fu sa\u011flanmazsa buna dair bir yapt\u0131r\u0131m bulunur.<\/p>\n\n\n\n<p>Genel kurula bu talepte bulunan kat malikinin <strong>karar\u0131 \u00f6\u011frenmesinden itibaren 1 ay i\u00e7inde<\/strong> sulh hukuk mahkemesine dava a\u00e7ma hakk\u0131 bulunuyor. Ayr\u0131ca kat malikleri<strong> de\u011fi\u015fim karar\u0131n\u0131n al\u0131n\u0131\u015f\u0131ndan itibaren 6 ay i\u00e7inde<\/strong> de yine ayn\u0131 \u015fekilde dava a\u00e7abiliyor. Kat malikleri y\u00f6netim plan\u0131nda yap\u0131lan de\u011fi\u015fikliklerin hukuka ayk\u0131r\u0131 oldu\u011funu d\u00fc\u015f\u00fcn\u00fcyorlarsa bu karara kar\u015f\u0131 da sulh mahkemesine ba\u015fvurup de\u011fi\u015fikli\u011fin iptalini isteme hakk\u0131na sahip. Bir kat malikinin y\u00f6netim plan\u0131 de\u011fi\u015fikli\u011fi hakk\u0131ndaki toplant\u0131da olumlu oy kullanm\u0131\u015fsa dava a\u00e7ma hakk\u0131na sahip olamad\u0131\u011f\u0131n\u0131 da hat\u0131rlatmak isteriz.<\/p>\n\n\n\n<p>Davan\u0131n ta\u015f\u0131nd\u0131\u011f\u0131 sulh mahkemesi y\u00f6netim plan\u0131n\u0131n hukuka ayk\u0131r\u0131 maddelerini k\u0131smen iptal edebilir.<\/p>\n\n\n\n<p>Y\u00f6netim plan\u0131 ile ilgili bilmeniz gerekenler bunlar.
