Herhangi bir yerin idaresi taraf\u0131ndan (belediyeler, \u00fcniversiteler, Karayollar\u0131 Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc, Devlet Su \u0130\u015fleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc (DS\u0130) veya k\u00f6y t\u00fczel ki\u015filikleri gibi) bir m\u00fclk kamula\u015ft\u0131r\u0131lmaya karar verildi\u011finde bedeli sahibine pe\u015fin olarak \u00f6denmek \u015fart\u0131yla m\u00fclk \u00fczerinde hak sahibi olabiliyor. S\u00fcre\u00e7 <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.2942.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">istimlak kanununda<\/a> belirtilen esas ve usullere g\u00f6re ilerletiliyor. Yani \u00f6ncelikle bu i\u015flemi ger\u00e7ekle\u015ftirmeyi planlayan idarenin m\u00fclk\u00fc kamula\u015ft\u0131rmak i\u00e7in ge\u00e7erli bir sebebe sahip olmas\u0131 gerekiyor. Aksi takdirde idareler sadece kendi se\u00e7imleri do\u011frultusunda \u00f6zel ki\u015filere ait olan m\u00fclkiyetler \u00fczerinde herhangi bir i\u015flem ba\u015flatma hakk\u0131na sahip de\u011fil.<\/p>\n\n\n\n<p>\u0130dare e\u011fer m\u00fclk\u00fc kamula\u015ft\u0131rmak i\u00e7in yeterli \u00f6dene\u011fe de sahipse bir sonraki a\u015famaya ge\u00e7iliyor. M\u00fclk\u00fcn kay\u0131tl\u0131 oldu\u011fu tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne m\u00fclk\u00fcn tapu siciline \u015ferh verilmesi talebi bildiriliyor. M\u00fclk sahibineyse bir tebligat g\u00f6nderiliyor. Daha sonra ki\u015fi ta\u015f\u0131nmaz\u0131 i\u00e7in kararla\u015ft\u0131r\u0131lan istimlak bedelinin taraf\u0131na sunulmas\u0131 i\u00e7in bir uzla\u015fma komisyonuna \u00e7a\u011f\u0131r\u0131l\u0131yor. Bu bedel e\u011fer kabul edilirse herhangi bir ko\u015ful olmadan m\u00fclk sahibine pe\u015fin ve nakit olarak \u00f6deniyor. Bu bedelin \u00f6denmesi gereken s\u00fcreyse kanun kapsam\u0131nda 45 g\u00fcn olarak belirtiliyor. Ancak baz\u0131 durumlarda istimlak bedeli taksitli olarak da \u00f6denebiliyor. Bu taksitlerin idare taraf\u0131ndan 5 sene i\u00e7erisinde \u00f6denip tamamlanm\u0131\u015f olmas\u0131 zorunlu.<\/p>\n\n\n\n<p>Kamula\u015ft\u0131r\u0131lmas\u0131 planlanan m\u00fclk karayolu, metro, park, tramvay, otopark, mezarl\u0131k gibi kamu yarar\u0131na kullan\u0131lacak alanlar\u0131n in\u015fas\u0131n\u0131n imar planlar\u0131na dahil ediliyor. \u0130stimlak talebi olan idareler \u00f6zel m\u00fclkleri yukar\u0131da say\u0131lan ama\u00e7lar harici kullanam\u0131yor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u0130stimlak S\u00fcrecine Kar\u015f\u0131 \u00c7\u0131k\u0131labilir Mi? \u0130stimlak Davas\u0131 Nedir?<\/h2>\n\n\n\n<p>\u0130stimlak i\u015flemleri tamamlanmas\u0131 durumunda m\u00fclke bi\u00e7ilen de\u011fer Bay\u0131nd\u0131rl\u0131k ve \u0130skan Bakanl\u0131\u011f\u0131 taraf\u0131ndan belirleniyor. M\u00fclk sahibi sunulan bedeli kabul etmek zorunda de\u011fil. \u0130stimlak bedelinin m\u00fclk sahibinin kabul etmeyece\u011fi bir de\u011fer olmas\u0131 durumunda bu s\u00fcrece itiraz edilip mahkemeye ba\u015fvurulabiliyor. Mahkeme m\u00fclk\u00fcn bulundu\u011fu yere gidip ara\u015ft\u0131rma yapacak bir bilirki\u015fi atayarak kapsaml\u0131 bir de\u011ferlendirme raporlamas\u0131 sonucunda m\u00fclk\u00fcn de\u011ferini tespit ettiriyor. M\u00fclk\u00fcn konumu, durumu, y\u00fcz\u00f6l\u00e7\u00fcm\u00fc, \u00e7evresel fakt\u00f6rleri gibi \u015fartlar inceleniyor ve bu rapora g\u00f6re son karara var\u0131l\u0131yor. M\u00fclk sahibi e\u011fer daha \u00f6nceden bedeli kabul edip sonradan karar\u0131n\u0131 de\u011fi\u015ftirirse herhangi bir hukuki yola ba\u015fvuram\u0131yor.&nbsp;<\/p>\n\n\n\n<p>\u0130stimlak bedeli davalar\u0131 m\u00fclk\u00fc talep eden idare taraf\u0131ndan a\u00e7\u0131l\u0131yor ve masraflar\u0131 idare kar\u015f\u0131l\u0131yor. Bu konuyla ilgili davalar normal davalardan daha k\u0131sa s\u00fcr\u00fcyor ve yakla\u015f\u0131k 10 ila 12 ay aras\u0131nda sonu\u00e7lan\u0131yor. Dava s\u00fcreci sonu\u00e7lanana kadar da m\u00fclk sahibi ta\u015f\u0131nmaz\u0131n\u0131 bo\u015faltmak veya kullanmay\u0131 b\u0131rakmak zorunda de\u011fil.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">M\u00fclk\u00fc Geri Alabilmek M\u00fcmk\u00fcn M\u00fc?<\/h2>\n\n\n\n<p>E\u011fer kamula\u015ft\u0131r\u0131lma i\u015flemi kabul edilir, bedeli m\u00fclk sahibine \u00f6denir ancak bu karardan sonraki 5 y\u0131l i\u00e7erisinde bu alan\u0131 kamula\u015ft\u0131rmak isteyen idare m\u00fclk \u00fczerinde hi\u00e7bir i\u015flem yapmazsa m\u00fclk\u00fc geri sat\u0131n alabilmek m\u00fcmk\u00fcn.
