Bu durumu \u00e7\u00f6zmek i\u00e7in bilinmesi gereken baz\u0131 hukuki detaylar vard\u0131r.<\/p>\n\n\n\n<p>T\u00fcrk Bor\u00e7lar Kanunu&#8217;na g\u00f6re yeni ev sahibinin kirac\u0131y\u0131 evden \u00e7\u0131karma hakk\u0131, belirli \u015fartlara ba\u011flanm\u0131\u015ft\u0131r. Taraflar bu s\u00fcre\u00e7te kendi iradeleriyle karar verme hakk\u0131na sahip de\u011fildir. Hem ev sahibi taraf\u0131 olarak, hem de kirac\u0131 taraf\u0131 olarak haklar\u0131n\u0131z hakk\u0131nda bilgi sahibi olmal\u0131s\u0131n\u0131z. Sizler i\u00e7in haz\u0131rlad\u0131\u011f\u0131m\u0131z bu rehberle, kirac\u0131 ve ev sahibi haklar\u0131n\u0131z\u0131 \u00f6\u011frenerek bu durumu nas\u0131l \u00e7\u00f6zebilece\u011finizi \u00f6\u011freneceksiniz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Yeni Ev Ald\u0131m Kirac\u0131y\u0131 Nas\u0131l \u00c7\u0131karabilirim?<\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.konaak.com\/blog\/wp-content\/uploads\/2023\/09\/Guide-for-Tenants-Who-Moved-Out-but-the-Landlord-Wont-Let-Them-Go-How-Can-I-Evict-a-Tenant.jpg\" alt=\"kirac\u0131 evden \u00e7\u0131km\u0131yor\" class=\"wp-image-78430\"\/><\/figure>\n\n\n\n<p>Yeni sat\u0131n al\u0131nan bir konutta kirac\u0131n\u0131n olmas\u0131, yeni ev sahibine do\u011frudan kirac\u0131y\u0131 \u00e7\u0131kartma hakk\u0131n\u0131 do\u011furmaz. Yani &#8220;ev ald\u0131m kirac\u0131 evden \u00e7\u0131km\u0131yor&#8221; diye d\u00fc\u015f\u00fcn\u00fcyor olabilirsiniz. Ancak bunun i\u00e7in belli \u015fartlar\u0131n olu\u015fmas\u0131 ve yasal s\u00fcrenin dolmas\u0131 gerekti\u011fi konusunda sizi uyaral\u0131m.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Kirac\u0131 Evden \u00c7\u0131km\u0131yor: Kira Bedeli Gecikmesi<\/h3>\n\n\n\n<p>Kirac\u0131n\u0131n en az 2 kez kira bedelini geciktirmesi bu nedenlerden biridir. Bu nedenin ge\u00e7erli olabilmesi i\u00e7in ev sahibinin yaz\u0131l\u0131 ihtar \u00e7ekmesi gerekir. Kirac\u0131n\u0131n kiray\u0131 2 defa geciktirmesi ve ev sahibinin de ayn\u0131 say\u0131da ihtar \u00e7ekmesi yeterlidir. B\u00f6ylelikle ev sahibi s\u00f6zle\u015fme bitiminde dava a\u00e7arak kirac\u0131y\u0131 \u00e7\u0131karma hakk\u0131na sahip olur.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Kirac\u0131 Evden \u00c7\u0131km\u0131yor: Ev Sahibinin Konuta \u0130htiyac\u0131 Olmas\u0131<\/h3>\n\n\n\n<p>E\u011fer ev sahibinin ba\u015fka bir ta\u015f\u0131nmaz\u0131 yoksa veya konuta ihtiyac\u0131 mevcutsa, kirac\u0131n\u0131n tahliye edilmesi i\u00e7in dava a\u00e7ma hakk\u0131na sahiptir. Davan\u0131n a\u00e7\u0131labilmesi i\u00e7in konutu devrald\u0131\u011f\u0131 tarihten itibaren 1 ay i\u00e7erisinde kirac\u0131ya yaz\u0131l\u0131 bildirim yapmas\u0131 gereklidir. Ev sahibinin bildirim yapt\u0131ktan sonra dava a\u00e7abilmesi i\u00e7in en az 6 ay beklemesi gerekir. Kirac\u0131ya bu hak kanunlarla tan\u0131nm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Ancak dava a\u00e7\u0131lmas\u0131 ev sahibi lehine kesin h\u00fck\u00fcm \u00e7\u0131kaca\u011f\u0131 anlam\u0131na gelmez. Burada malikin konuta ihtiyac\u0131 konusunda samimi olmas\u0131 \u015fart\u0131 gereklidir. Malik kendisinin, bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu bireylerin, altsoyundan(\u00e7ocuk, torun) veya \u00fcstsoyundan(anne, baba, vs.) bireylerin eve ihtiyac\u0131 oldu\u011funu ispat etmelidir. Bor\u00e7lar Kanunu\u2019nda ev sahiplerine bu hak tan\u0131nm\u0131\u015ft\u0131r. Ayr\u0131ca \u00f6ne s\u00fcrd\u00fc\u011f\u00fc ihtiya\u00e7 k\u0131sa s\u00fcreli de\u011fil s\u00fcrekli olmal\u0131d\u0131r. Bunun yan\u0131nda ev sahibinin o konumda ba\u015fka bir ta\u015f\u0131nmaz\u0131n\u0131n olmamas\u0131 gerekir.&nbsp;<\/p>\n\n\n\n<ul>\n<li>Bildirim Yap\u0131n: Yeni ev sahibi olarak sizin \u00fczerinizde birtak\u0131m y\u00fck\u00fcml\u00fcl\u00fckler vard\u0131r. \u00d6zellikle &#8220;ev ald\u0131m kirac\u0131 \u00e7\u0131km\u0131yor&#8221; durumlar\u0131nda ilk yap\u0131lmas\u0131 gereken, m\u00fclk\u00fc sat\u0131n ald\u0131\u011f\u0131n\u0131z tarihten itibaren 1 ay i\u00e7inde kirac\u0131ya yaz\u0131l\u0131 olarak durumu bildirmektir. Bu bildirimi noter arac\u0131l\u0131\u011f\u0131yla yapman\u0131z ispat kolayl\u0131\u011f\u0131 a\u00e7\u0131s\u0131ndan avantaj sa\u011flar; fakat noter zorunlulu\u011fu bulunmamaktad\u0131r.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>6 Ayl\u0131k S\u00fcre: Bildirimi yapt\u0131ktan sonra 6 ayl\u0131k bir s\u00fcre i\u00e7inde tahliye davas\u0131 a\u00e7abilirsiniz. Bu s\u00fcre, genellikle devrin ger\u00e7ekle\u015fti\u011fi tarihten itibaren ba\u015flar. S\u00f6zle\u015fmenin kalan s\u00fcresi 6 aydan k\u0131sa ise, s\u00f6zle\u015fmenin bitiminden itibaren 1 ay i\u00e7inde dava a\u00e7abilirsiniz. Bu durumda ek bir bildirim yap\u0131lmas\u0131na gerek yoktur.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>Birden Fazla Kirac\u0131 Durumu: E\u011fer kiralanan yerde birden fazla kirac\u0131 varsa, bildirimin her
