Teklifte; konutlar\u0131n turizm ama\u00e7l\u0131 kiralanmas\u0131ndan, farkl\u0131 kanunlara eklemeler yap\u0131lmas\u0131na kadar \u00e7e\u015fitli konular ele al\u0131n\u0131yor.&nbsp;<\/p>\n\n\n\n<p>Bu kapsamda, 2252 say\u0131l\u0131 K\u00fclt\u00fcr Bakanl\u0131\u011f\u0131 D\u00f6ner Sermaye Kanunu, 2634 say\u0131l\u0131 Turizmi Te\u015fvik Kanunu, 7174 say\u0131l\u0131 Kapadokya Alan\u0131 Hakk\u0131nda Kanun ve 7173 say\u0131l\u0131 T\u00fcrkiye Turizm Tan\u0131t\u0131m ve Geli\u015ftirme Ajans\u0131 Hakk\u0131nda Kanun&#8217;a ili\u015fkin maddeler de teklifte yer buldu. Maddelerin ayr\u0131nt\u0131l\u0131 olarak neyi d\u00fczenledi\u011fini ise maddeler \u015feklinde size aktaraca\u011f\u0131z.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Konutlar\u0131n Turizm Ama\u00e7l\u0131 Kiralanmas\u0131&#8217;na Y\u00f6nelik Y\u00f6netmelikte Son Durum<\/h3>\n\n\n\n<p>28 Aral\u0131k 2023 tarihinde, Turizm ve K\u00fclt\u00fcr Bakanl\u0131\u011f\u0131 y\u00f6netiminde 100 g\u00fcn alt\u0131 konut kiralamalar\u0131n\u0131 kapsayan &#8220;<a href=\"https:\/\/www.resmigazete.gov.tr\/eskiler\/2023\/12\/20231228-1.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Konutlar\u0131n Turizm Ama\u00e7l\u0131 Kiralanmas\u0131na \u0130li\u015fkin Y\u00f6netmelik<\/a>&#8221; Resmi Gazete&#8217;de yay\u0131nland\u0131. Bu y\u00f6netmelikle birlikte, g\u00fcnl\u00fck ve k\u0131sa d\u00f6nem kiralama yapmak isteyen herkesin y\u00f6netmelikte yer alan gereklilikleri yerine getirmeleri zorunlu. Airbnb gibi uygulamalar \u00fczerinden kiralama yap\u0131yorsan\u0131z izin belgesine ba\u015fvurman\u0131z gerekiyor. Ancak bu yetki, valiliklere de devredilebilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Kat Maliklerinin Oyu<\/h3>\n\n\n\n<p>E\u011fer bir apartman veya site i\u00e7inde turizm ama\u00e7l\u0131 kiralama yapmak isteniyorsa, bu karar t\u00fcm kat maliklerinin oy birli\u011fi ile al\u0131nmal\u0131d\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00dcst Limitler<\/h3>\n\n\n\n<p>\u00dc\u00e7ten fazla daire bulunan binalarda; daire say\u0131s\u0131n\u0131n azami yu\u0308zde yirmi be\u015fi kadar, ayn\u0131 kiraya veren ad\u0131na izin belgesi du\u0308zenlenebileceg\u0306i belirtilmi\u015ftir. Yani o\u0308rneg\u0306in; 40 daireli bir apartmanda; bir<br>ki\u015finin 10 dairesi varsa hepsi i\u00e7in kendi ad\u0131na izin belgesi du\u0308zenlenmesi mu\u0308mku\u0308n. Fakat bu ki\u015finin ayn\u0131 apartmanda 20 dairesi olmas\u0131 durumunda, sadece 10&#8217;u i\u00e7in k\u0131sa d\u00f6nem kiralama yapabilir. <\/p>\n\n\n\n<p>Ayr\u0131ca, bir kiraya veren, bir bina i\u00e7inde bulunan dairelerden 5 veya daha fazlas\u0131 i\u00e7in \u0130zin Belgesi<br>ba\u015fvurusu yapmak ister ise; ba\u015fvuruda i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 sunulmas\u0131 da gerekir. Bununla birlikte; ba\u015fvuruya konu bina bir site i\u00e7erisinde yer al\u0131yorsa, bu kez sitede bulunan t\u00fcm<br>kat maliklerinin onay\u0131 gerekecektir.<\/p>\n\n\n\n<p>Resepsiyon, g\u00fcvenlik ve g\u00fcnl\u00fck temizlik servisi mek\u00e2nlar\u0131n\u0131n bulundu\u011fu, sa\u011fl\u0131k hizmetleri, kuru temizleme, \u00e7ama\u015f\u0131rhane, ta\u015f\u0131ma, yemek ve al\u0131\u015fveri\u015f servisi hizmetleri ile spor salonu ve y\u00fczme havuzu gibi hizmetlerin verilebildi\u011fi birden fazla ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fc ihtiva eden y\u00fcksek nitelikli konutlar i\u00e7in, yeni rezidanslar i\u00e7in ise; ayr\u0131 bir d\u00fczenleme \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. \u015e\u00f6yle ki; bir rezidans\u0131n y\u00f6netim plan\u0131nda \u201ck\u0131sa s\u00fcreli kiralama faaliyetine izin verildi\u011fine\u201d dair bir h\u00fck\u00fcm bulunuyor ise; bu rezidanslar i\u00e7in herhangi bir s\u0131n\u0131rlama getirilmeksizin izin belgesi d\u00fczenlenebilece\u011fi belirtilmi\u015ftir.<\/p>\n\n\n\n<p>Tani; y\u00f6netim plan\u0131 ile k\u0131sa s\u00fcreli kiralama yap\u0131labilece\u011fi belirtilen rezidans dairelerinin, y\u00fcz<br>g\u00fcnden k\u0131sa s\u00fcreli kiralamalar\u0131nda;<\/p>\n\n\n\n<ol>\n<li>Kat maliklerinin t\u00fcm\u00fcn\u00fcn onay\u0131 aranmayacak;<\/li>\n\n\n\n<li>Daire say\u0131s\u0131n\u0131n maksimum %25\u2019i kadar\u0131 i\u00e7in kiralama yap\u0131labilece\u011fi h\u00fckm\u00fc uygulanmayacak,<br>yani s\u0131n\u0131rs\u0131z daire i\u00e7in y\u00fcz g\u00fcnden k\u0131sa s\u00fcreli kiralama yap\u0131labilecek;<\/li>\n\n\n\n<li>5 daireden fazla daire i\u00e7in i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 &amp; site maliklerinin t\u00fcm\u00fcn\u00fcn onay\u0131<br>aranmayacakt\u0131r.<\/li>\n<\/ol>\n\n\n\n<p>Rezidanstaki dairelerin kiralama faaliyetlerinin \u201ckonut i\u015fletmesi\u201d taraf\u0131ndan da yap\u0131labilece\u011fi d\u00fczenlenmi\u015f, bu durumda izin belgesinin, konut i\u015fletmesini yapan \u015firket ad\u0131na d\u00fczenlenece\u011fi belirtilmi\u015ftir. Ancak, \u201ckonut i\u015fletmesi\u201d tan\u0131m\u0131 yap\u0131lmam\u0131\u015ft\u0131r. Yani ev sahiplerinin turizm konutunda kalacak ki\u015fileri KBS sistemine kaydetmeleri yasal olarak zorunludur. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">S\u00f6zle\u015fme S\u00fcresi<\/h3>\n\n\n\n<p>\u0130zin belgesi sahibi ile kirac\u0131 aras\u0131ndaki s\u00f6zle\u015fme, belirtilen s\u00fcre sonunda otomatik olarak sona erer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Madde 4: \u0130zinsiz Kiralama ve \u0130lgili Cezalar<\/h2>\n\n\n\n<p>Bu madde, evlerin turizm ama\u00e7l\u0131 kiralanmas\u0131nda izinsiz faaliyet g\u00f6sterenlere uygulanacak olan idari yapt\u0131r\u0131mlar\u0131 belirliyor.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u0130zin Belgesi Olmadan Kiralama<\/h3>\n\n\n\n<p>\u0130zinsiz kiralama yap\u0131lmas\u0131 durumunda, kiralanan her bir konut i\u00e7in ilk olarak 100.000 TL ceza kesilir. 15 g\u00fcn i\u00e7inde izin belgesi al\u0131nmazsa, bu ceza 500.000 TL&#8217;ye y\u00fckseltilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00dc\u00e7\u00fcnc\u00fc Ki\u015filere Kiralama:<\/h3>\n\n\n\n<p>\u0130zin belgesi sahibinden kiralad\u0131\u011f\u0131 turizm ama\u00e7l\u0131 konutu kendi nam ve hesab\u0131na \u00fc\u00e7\u00fcnc\u00fc<br>ki\u015filere kiraya verenler hakk\u0131nda her bir s\u00f6zle\u015fme i\u00e7in 100.000 T\u00fcrk liras\u0131 idari para cezas\u0131<br>uygulan\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Arac\u0131l\u0131k Edenler<\/h3>\n\n\n\n<p>\u0130zin belgesi olmadan kiralanan evlerde arac\u0131l\u0131k eden ki\u015filere, her bir s\u00f6zle\u015fme i\u00e7in 100.000 TL ceza kesilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Elektronik Ticaret<\/h3>\n\n\n\n<p>Elektronik ortamlarda izinsiz kiralama yap\u0131l\u0131yorsa, bu platformlara 100.000 TL ceza uygulan\u0131r ve i\u00e7eriklerine eri\u015fim engellenir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Di\u011fer \u0130hlaller<\/h3>\n\n\n\n<p>Bakanl\u0131\u011f\u0131n istedi\u011fi bilgi\/belgelerin zaman\u0131nda verilmemesi, kiralanan evin s\u00f6zle\u015fmeye uygun olarak teslim edilmemesi veya Bakanl\u0131k taraf\u0131ndan verilen plaketin konut giri\u015fine as\u0131lmamas\u0131 gibi ihlaller i\u00e7in de cezalar mevcuttur.<\/p>\n\n\n\n<p>K\u0131sacas\u0131, evlerin turizm ama\u00e7l\u0131 kiralanmas\u0131nda izin belgesinin \u00f6nemli oldu\u011funu ve izinsiz faaliyetlerin ciddi yapt\u0131r\u0131mlar\u0131 oldu\u011funu unutmamak gerekir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Madde 5: Konut Turizm \u0130zin Belgesinin \u0130ptali<\/h2>\n\n\n\n<p>Konutun turizm ama\u00e7l\u0131 kiralanabilmesi i\u00e7in gereken &#8220;izin belgesi&#8221;nin, belirli durumlarda iptal edilmesi hakk\u0131nda bilgi i\u00e7eriyor.&nbsp;<\/p>\n\n\n\n<ul>\n<li>\u0130zin belgesi, sahibinin iptalini talep etmesi durumunda iptal edilebilir.<\/li>\n\n\n\n<li>E\u011fer bir konutun turizm ama\u00e7l\u0131 kiralama faaliyetine son verildi\u011fi anla\u015f\u0131l\u0131rsa, bu konut i\u00e7in al\u0131nan izin belgesi iptal edilir. Birinci maddeye g\u00f6re, izin belgesinin yeni sahibi taraf\u0131ndan otuz g\u00fcn i\u00e7inde ba\u015fvuru yap\u0131lmazsa ya da izin belgesi sahibi de\u011fi\u015fikli\u011fi kabul edilip y\u00fck\u00fcml\u00fcl\u00fckler yerine getirilmezse izin belgesi iptal olur.<\/li>\n\n\n\n<li>Konutun kamu d\u00fczenine, kamu g\u00fcvenli\u011fine veya genel ahlaka ayk\u0131r\u0131 bir \u015fekilde kullan\u0131ld\u0131\u011f\u0131, yetkili kamu kurumlar\u0131 taraf\u0131ndan rapor edilirse, bu konut i\u00e7in al\u0131nan izin belgesi iptal edilir. Birinci maddeye ba\u011fl\u0131 olarak, belirlenen sa\u011fl\u0131k ve hijyen kurallar\u0131na uyulmad\u0131\u011f\u0131n\u0131 belirten bir idari para cezas\u0131 uyguland\u0131ysa ve verilen s\u00fcre zarf\u0131nda bu kurallara uyulmad\u0131\u011f\u0131 tespit edilirse, izin belgesi iptal edilir.<\/li>\n\n\n\n<li>\u0130ptal edilen izin belgesine sahip konutlar\u0131n kirac\u0131lar\u0131 ya da kullan\u0131c\u0131lar\u0131, var olan s\u00f6zle\u015fme s\u00fcresi sonuna kadar haklar\u0131na devam edebilir.<\/li>\n<\/ul>\n\n\n\n<p>Bu madde, turizm ama\u00e7l\u0131 kiral\u0131k konutlarda hangi durumlarda izin belgesinin iptal edilece\u011fini a\u00e7\u0131k ve anla\u015f\u0131l\u0131r bir \u015fekilde ortaya koymaktad\u0131r. Konut sahiplerinin bu kurallara uymalar\u0131, hem kendileri hem de kirac\u0131lar\u0131 i\u00e7in \u00f6nemlidir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Madde 6: Konut Turizm \u0130zin Belgesi Denetim ve D\u00fczenleme Yetkisi&nbsp;<\/h2>\n\n\n\n<p>Konut Turizm izin belgesinin denetim ve d\u00fczenleme yetkisini a\u00e7\u0131kl\u0131yor.&nbsp;<\/p>\n\n\n\n<ul>\n<li>Bakanl\u0131k, turizm ama\u00e7l\u0131 kiralamalar\u0131 denetleme yetkisine sahiptir ve gerekti\u011finde bu yetkiyi valilikler arac\u0131l\u0131\u011f\u0131yla kullanabilir.&nbsp;<\/li>\n\n\n\n<li>Bakanl\u0131k, Kanunun uygulanmas\u0131ndaki belirsizlikleri giderme ve uygulama birli\u011fini sa\u011flama yetkisine de sahiptir.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Daha \u00d6nce Yap\u0131lan Turizm Ama\u00e7l\u0131 Kiralamalar&nbsp;<\/h3>\n\n\n\n<p>Mevcut turizm ama\u00e7l\u0131 kiralama faaliyetleri i\u00e7in belirtilen s\u00fcre i\u00e7inde izin belgesi al\u0131nmas\u0131 gerekmektedir. Belirtilen s\u00fcre, kanunun y\u00fcr\u00fcrl\u00fc\u011fe girmesinin ard\u0131ndan 1 ayd\u0131r. Uymayanlar 4. Madde uyar\u0131nca cezaya tabidir.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Konutlar\u0131n Turizm Ama\u00e7l\u0131 Kullan\u0131lmas\u0131 Madde 7: Tan\u0131msal D\u00fczenleme<\/h3>\n\n\n\n<p>Bu maddede ilgili kanunda bir yasal tan\u0131m d\u00fczenlendi.&nbsp;<\/p>\n\n\n\n<p>11\/7\/2019 tarihli ve 7183 say\u0131l\u0131 T\u00fcrkiye Turizm Tan\u0131t\u0131m ve Geli\u015ftirme Ajans\u0131 Hakk\u0131nda Kanunun 3 \u00fcnc\u00fc maddesinde yap\u0131lan de\u011fi\u015fikli\u011fe paralellik sa\u011flanmas\u0131 amac\u0131yla uyum d\u00fczenlemesi ger\u00e7ekle\u015ftirildi.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Konutlar\u0131n Turizm Ama\u00e7l\u0131 Kullan\u0131lmas\u0131  Madde 8: K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131 D\u00f6ner Sermayesi Art\u0131\u015f\u0131<\/h3>\n\n\n\n<p>Bu maddeyle, K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131 d\u00f6ner sermayesi 300 milyon TL&#8217;den 1.5 milyar TL&#8217;ye y\u00fckseltiliyor. Gelir kaynaklar\u0131 aras\u0131na kart, belge, plaket, kokart ve benzeri gelirler, altyap\u0131 tesisleri gibi at\u0131k su ar\u0131tma ve kat\u0131 at\u0131k bertaraf tesislerinden elde edilen \u00fccretler ve gelirler ekleniyor.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Madde 11: K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131 D\u00f6ner Sermaye \u0130\u015fletmesinin Yetkilerine Eklemeler<\/h3>\n\n\n\n<p>Bu maddeyle, D\u00f6ner Sermaye \u0130\u015fletmesi Merkezi M\u00fcd\u00fcrl\u00fc\u011f\u00fc&#8217;n\u00fcn yetkileri geni\u015fletiliyor. 2634 say\u0131l\u0131 Kanun kapsam\u0131nda at\u0131k su ar\u0131tma ve kat\u0131 at\u0131k bertaraf tesislerini i\u015fletme veya i\u015flettirme yetkisi bu i\u015fletmeye tan\u0131n\u0131yor.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Madde 12: K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131n\u0131n Tahsis Yetkisinin Geni\u015fletilmesi<\/h3>\n\n\n\n<p>Bu maddeyle, personel lojman\u0131 alanlar\u0131n\u0131n tan\u0131m\u0131 ve tahsis edilme ko\u015fullar\u0131 yeniden d\u00fczenleniyor. Art\u0131k, personel lojman\u0131 alan\u0131 i\u00e7in ta\u015f\u0131nmaz\u0131n K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131ndan direkt tahsisli olmas\u0131 gerekmiyor.&nbsp;<\/p>\n\n\n\n<p>Turizm belgeli konaklama tesisi olan \u00f6zel m\u00fclkiyetlere de personel lojman\u0131 alan\u0131 tahsis edilebilecek.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Konutlar\u0131n Turizm Ama\u00e7l\u0131 Madde 13: Konaklama Tesislerinin \u0130\u015fletme Belgesi ve Ruhsat Ko\u015fullar\u0131 De\u011fi\u015fikli\u011fi<\/h3>\n\n\n\n<p>Konaklama tesislerinin i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 al\u0131nd\u0131ktan sonraki turizm i\u015fletmesi belgesi alma s\u00fcresi 1 y\u0131ldan 6 aya indiriliyor. E\u011fer bir i\u015fletmenin i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 iptal edilirse, bu i\u015fletmenin yeni bir ruhsat alabilmesi i\u00e7in K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131ndan bir &#8220;uygun g\u00f6r\u00fc\u015f yaz\u0131s\u0131&#8221; almas\u0131 ve bu yaz\u0131y\u0131 yetkili idareye sunmas\u0131 gerekiyor.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Konutlar\u0131n Turizm Ama\u00e7l\u0131 Madde 14: Milli Parklar \u0130\u00e7erisindeki Turizm Tesisi Tahsisi ve \u00c7ad\u0131r Karavan Alanlar\u0131<\/h3>\n\n\n\n<p>Milli Parklar Kanunu kapsam\u0131nda belirlenen alanlarda sadece \u00e7ad\u0131r ve karavan i\u00e7in kamp alan\u0131 d\u0131\u015f\u0131nda konaklama tesisleri tahsis yetkisini K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131na veriyor. Tahsis edilen yerlerden sa\u011flanan gelirler ilgili kuruma aktar\u0131lacak.&nbsp;<\/p>\n\n\n\n<p>Bakanl\u0131k\u00e7a belgeli tesisler i\u00e7in personel lojman\u0131 tahsis s\u00fcresi ve \u015fartlar\u0131 belirlendi. Belgeli tesislerin tahsis s\u00fcresi maksimum 49 y\u0131l olarak s\u0131n\u0131rland\u0131r\u0131l\u0131yor.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Konutlar\u0131n Turizm Ama\u00e7l\u0131 Madde 15: Ormanl\u0131k Alanlardaki Kamp Alan\u0131 Kiralamalar\u0131<\/h3>\n\n\n\n<p>Bu maddeyle, ormanl\u0131k alanlarda yaln\u0131zca \u00e7ad\u0131r ve karavan i\u00e7in kamp alanlar\u0131 kurulabilece\u011fi belirtildi. Bu alanlarda sadece kamp amac\u0131 d\u0131\u015f\u0131nda kullan\u0131m yap\u0131lamayacak.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Konutlar\u0131n Turizm Ama\u00e7l\u0131 Madde 16: Yat\u0131r\u0131mc\u0131 S\u00f6zle\u015fmelerinin Uyarlanma S\u00fcresinin Uzat\u0131lmas\u0131&nbsp;<\/h3>\n\n\n\n<p>Bu maddeyle, konaklama ve k\u0131\u015f turizmi i\u00e7in yap\u0131lan kiralama s\u00f6zle\u015fmelerinin 8. maddeye g\u00f6re uyarlanmas\u0131 i\u00e7in ba\u015fvuru s\u00fcresi uzat\u0131ld\u0131. Bu, ba\u015fvuruda bulunamayan yat\u0131r\u0131mc\u0131lara yeni bir ba\u015fvuru f\u0131rsat\u0131 sunuyor.&nbsp;<\/p>\n\n\n\n<p>S\u00f6zle\u015fme uyarlamalar\u0131ndan elde edilen gelirler ilgili kurumlarca tahsil edilir.
