GYF\u2019ler, <a href=\"https:\/\/www.mevzuat.gov.tr\/File\/GeneratePdf?mevzuatNo=19227&amp;mevzuatTur=Teblig&amp;mevzuatTertip=5\" target=\"_blank\" rel=\"noreferrer noopener\">6362 say\u0131l\u0131 SPK Kanunu\u2019nun 53. maddesi<\/a>nde d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n<p>Kurucular bu fonu, SPK&#8217;n\u0131n belirledi\u011fi varl\u0131k ve i\u015flemler \u00fczerinde, pay sahiplerinin menfaatine inan\u00e7l\u0131 m\u00fclkiyet prensipleri \u00e7er\u00e7evesinde y\u00f6netirler. Bu fon, s\u00fcreli veya s\u00fcresiz olarak kurulabilen ve t\u00fczel ki\u015fili\u011fi bulunmayan bir malvarl\u0131\u011f\u0131 olarak tan\u0131mlan\u0131r. Ancak, tapu i\u015flemleri i\u00e7in t\u00fczel ki\u015fili\u011fi olan bir yap\u0131ya sahiptir.<\/p>\n\n\n\n<p>Yat\u0131r\u0131m\u0131n temeli, toplanan sermayenin, uzman bir portf\u00f6y y\u00f6netimi alt\u0131nda gayrimenkul varl\u0131klar\u0131na y\u00f6nlendirilmesi ve bu varl\u0131klardan elde edilen kira geliri veya al\u0131m-sat\u0131m k\u00e2rlar\u0131ndan pay sahiplerine gelir da\u011f\u0131t\u0131lmas\u0131d\u0131r.<\/p>\n\n\n\n<p>Kurucular GYF&#8217;leri belirli bir s\u00fcreyle ya da s\u00fcresiz olarak olu\u015fturabilirler. Ayr\u0131ca GYF&#8217;ler t\u00fczel ki\u015fili\u011fe sahip olmayan mal varl\u0131klar\u0131d\u0131r. Bu fonlar, portf\u00f6y de\u011ferinin en az %80&#8217;ini gayrimenkul yat\u0131r\u0131mlar\u0131ndan olu\u015fturmak zorundad\u0131r. Portf\u00f6ylerinde gayrimenkul sat\u0131n alabilir, satabilir, kiralayabilir ve gayrimenkul sat\u0131n alma veya satma vaadinde bulunabilirler.<\/p>\n\n\n\n<p>Bununla birlikte, GYF&#8217;lerin gayrimenkul projelerine direkt yat\u0131r\u0131m yapmalar\u0131, in\u015faat i\u015flerini \u00fcstlenmeleri veya otel, hastane gibi ticari gayrimenkulleri i\u015fletmeleri m\u00fcmk\u00fcn de\u011fildir.
